Returns and Refunds Policy

The Consumer Rights Act 2015 requires that any Product which you order from us must be as described and that it must be in satisfactory condition.
If for any reason you should wish to return a product, please be advised under paragraph ‘8. Returns’.

The following provides you with information about us and our legal Terms of Business and the sale of any product listed on our website to you, the consumer, who purchases goods from us.
For ease of use we define the following as such:
A. ‘We’ refers to Casa Agave Ltd
B. ‘Our website’ refers to www.casa-agave.com
C. ‘Product’ refers to all items that we sell and are listed on our website

By using this web site, you agree to be bound by the following Terms and Conditions of Use and all applicable laws and regulations. You also agree that you are responsible for compliance with any local laws. If the following terms are not agreed with, you are prohibited from the use or any access to our site. The materials contained in this web site are in their entirety protected by applicable copyright and trade mark law.

1. Casa Agave Ltd

1.1 We, the owners of www.casa-agave.com, are Casa Agave Limited, and are registered wholesalers and retailers in the United Kingdom under the company number 9495136

1.2 Our main trading address is 15-16 Hurts Yard, NG1 6JD, Nottingham, Nottinghamshire, England. We are also registered for VAT, which number is 216 4663 12.

1.3 If you wish to contact us for any reasons including complaints, you can do so by sending an email to info@casa-agave.com.

1.4 Any contact between you and us is recorded for the purpose of crime prevention, and training purposes. These records are kept strictly confidential. We reserve the right to share this information only when asked for it by law enforcement agencies.

1.5 Casa Agave Ltd doesn’t take any responsibility for technical, typographical, or photographic errors on its website and cannot confirm all content is accurate or current at all times. Casa Agave Ltd may correct, or make changes to the material contained in its web site at any time without notice.

1.6 Casa Agave Ltd is not responsible for the contents of any sites linked to its own web site. The inclusion of any link does not imply endorsement by Casa Agave Ltd and the use of any links to other web sites is at the user’s own risk.

1.7 Any claim to Casa Agave Ltd, its website, or any other affiliation, will be governed by UK laws without regard to its conflicting law provisions.

1.8 Casa Agave Ltd is fully licensed to canvas for, receive and sell alcoholic products and perform marketing support.

2. License of use

No permission will be given to download or save any of the material provided on this site, whether this is information, photos or software.
Therefore you are not permitted to modify or copy any material or transfer the materials to another person or mirror the materials on any other server or remove copyright of any other proprietary notations from the material.

3. Products

3.1 The tasting notes of each product on our website are written by ourselves and are in their entirety subjective. We cannot confirm that everyone will experience the same flavours, as different people have different palates.

3.2 All product details are to our knowledge correct and accurate, however we do not take responsibility for any changes made in their specification, as these are subject to change.

3.3 The images of each product on our website are for illustration purposes only. We therefore cannot guarantee that the product we deliver to you will be exactly the same as the products depicted on our website.

4. Age restrictions

4.1 It is illegal in the UK for

4.1.1 any person under the age of 18 to buy or attempt to buy alcohol for either themselves or for any other person under the age of 18 or above and

4.1.2 an adult to buy or attempt to buy alcohol for any person under the age of 18.

4.2 For the above mentioned points you may only purchase an alcoholic product from us if you are:

4.2.1 18 years old or above;

4.2.2 not buying any alcoholic product for any person or persons under the age of 18 and

4.2.3 of legal age to both purchase and consume said spirit or liqueur in the country where you place the order and the destination country.

5. Products available for ‘pre-order’

If you wish to order a product which is currently unavailable, you have the option to pre-order. This means that as soon as the product becomes available again we will seek to dispatch that product to you on or before the expected date of dispatch. Please note that events outside of our control may prevent us from doing this

6. Contract of Purchase

6.1 From the moment you place an order with us you are committing to a contract which legally binds you to purchasing the ordered goods.

6.2 We reserve the right to only send products for which payment has been processed, which may delay the expected time of arrival if payment has not been made.

6.3 We take no responsibility for delayed or failed delivery of a product that has resulted from your failure to provide correct address information.

6.4 If a product is returned to us because of the aforementioned reason, we reserve the right to require additional postage payment, which may include import duties, administration fees and taxes where applicable, before resending the product.

6. Variation of Terms

6.1 We reserve the right to amend these Terms at any time without notice. Please refer to the top of the page to see when they were last updated and for what reason.

6.2 When you order a product from us, the Terms in force at the time of your order will apply to the contract existing between you and us.

6.3 Reasons for revision of these Terms include changes in our ways of business and/or changes in relevant laws and regulations

7. Delivery

7.1 The packaging and postal costs will be displayed to you when placing your order and we will send an estimated delivery date with the confirmation of dispatch.

7.2 Occasionally our delivery to you can be affected by events outside of our control. When this happens we will inform you of the delivery progress

7.3 If no one is available at your address to accept the delivery and we have received no other instructions at the time of placing your order our carriers will usually leave your parcel with the local post office for you to collect.

7.4 All our orders must be signed for upon receipt and tracked. This also applies to returns (see more info on returns in paragraph 8. below)

8. Returns Policy

8.1 Casa Agave Ltd will accept the return of new, unopened, undamaged products within 14 days from delivery date. Returns after 14 days are subject to a 20% restocking fee.

8.2 The product must be in its original condition upon return, and must include proof of purchase.

8.3 Upon receipt of the returned product, the delivery of which must be recorded and signed for, the full amount of the item will be refunded.

If these conditions are not met then the return will not be honoured

8.4 We will refund you in the same manner in which you have used to paid.

8.6 All returned products need to have the order details enclosed

8.7 Returns must be sent and delivered to Casa Agave Ltd Returns within 14 days

8.8 We are under a legal duty to supply a Product that is in conformity with this Contract. As a consumer, you have legal rights in relation to a Product that is faulty. These legal rights are not affected by your right of return and refund in this paragraph 6 or anything else in these Terms

8.9 In the case of a returned product, the product needs to be received by us in its original condition.

8.10 Your right as a consumer to cancel this contract due to changing your mind, does not apply in the case of a product has been unsealed after you receive it. Our products are sealed for health protection purposes, and we will not accept an opened product.

8.11 If these conditions are not met then the return will not be honoured

Any product you have ordered is owned by you in full, only when payment has been completed and has been accepted by us
